Terms of Service

These Terms of Service ("Terms") govern the access to and use of the OBSIDIA platform, available at obsidiachart.com (the "Service"), operated by Jesús Calderón, individual natural person, domiciled at Av. Arenales 2252, Lince, Lima, Perú, email Obsidialabs.sol@gmail.com ("OBSIDIA", "we", "us").

By accessing or using the Service, you ("User", "you") acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must not use the Service.

⚠ CRITICAL NOTICE — NOT FINANCIAL ADVICE. OBSIDIA provides analytical software tools, not investment recommendations. No feature, indicator, signal, or output of the algorithmic bot constitutes financial advice, offer of securities, or recommendation to buy or sell any asset. Trading decisions are the User's sole responsibility. Cryptocurrency and leveraged futures trading involves substantial risk of loss and may result in the total loss of the invested capital. Never trade with funds you cannot afford to lose.

2. Eligibility and Restricted Jurisdictions

To use the Service, you must be at least 18 years old and have the legal capacity to enter into contracts in your jurisdiction.

The Service is not available to residents, citizens, or persons located in the following jurisdictions:

It is the User's sole responsibility to verify the legality of the use of the Service in their jurisdiction. OBSIDIA reserves the right to block or terminate access from any territory at any time without prior notice.

3. User Account

Registration is performed via Google OAuth 2.0 authentication. The User is responsible for:

To operate on exchanges (Binance, WEEX, BitMart), the User provides their own API keys. These credentials:

OBSIDIA is not responsible for losses arising from API keys with excessive permissions or from the exposure of the User's account to third parties.

4. Subscription Plans and Prices

4.1. Free Plan

Free access, no time limit, subject to fair use.

4.2. Monthly Plan (Pro)

Payments are processed by Paddle (Paddle.com Market Limited), Merchant of Record. Paddle's Terms of Service (paddle.com/legal/checkout-buyer-terms) additionally apply to the transaction.

The subscription renews automatically each month until the User cancels it. See the Refund Policy for details.

5. Acceptable Use

The User undertakes NOT to:

6. Intellectual Property

All source code, design, indicators, algorithms, trademarks, and content of OBSIDIA are the exclusive property of Jesús Calderón and are protected by Peruvian copyright laws and international treaties (WIPO, TRIPS).

The User is granted a limited, non-exclusive, non-transferable, revocable license to use the Service for their personal or business trading purposes, subject to these Terms.

7. Availability and Technical Limitations

OBSIDIA makes reasonable efforts to maintain the Service available 24/7, but does not guarantee uninterrupted access. The Service depends on:

8. Specific Risks of the Algorithmic Bot

⚠ The algorithmic trading bot operates with the User's real funds in their Binance account. When enabling "REAL" mode (as opposed to "DRY RUN" or simulation), the User:

OBSIDIA recommends starting in DRY RUN mode for at least 2 weeks before enabling real mode.

9. Limitation of Liability

To the maximum extent permitted by Peruvian law (Law 29571 — Consumer Protection Code, Law 29733 — Personal Data Protection), OBSIDIA's total liability arising from the use of the Service shall not exceed the total amount paid by the User in the twelve (12) months preceding the event.

10. Modifications to the Terms

OBSIDIA may modify these Terms at any time. Material changes will be notified via email or a prominent banner on the platform with at least 15 days' notice. Continued use of the Service after the effective date implies acceptance of the modifications.

The User may terminate their account at any time by writing to Obsidialabs.sol@gmail.com or through the cancellation panel within the Service.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Perú. Any dispute shall be submitted to the exclusive jurisdiction of the ordinary courts of Lima, Perú, except for consumer protection rights that the applicable law of the User's residence guarantees imperatively.

Users in the European Union additionally retain the rights granted by Regulation (EU) 2016/679 (GDPR) and by their local consumer protection legislation.
